These Terms of Service (“Terms”) govern your access to and use of www.heartlandweldingacademy.com (the “Site”), operated by Heartland Welding Academy (“Heartland Welding Academy,” “HWA,” “we,” “us,” or “our”).
By accessing the Site, submitting a form, or otherwise interacting with us through the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
1. Who May Use the Site
The Site is intended for use by individuals located in the United States who are at least 17 years of age, consistent with our admissions requirements. If you are under 18, you may use the Site and submit an inquiry only with the involvement and permission of a parent or legal guardian, and you should not consent to phone calls or text messages without that permission. Applicants who are 17 at the time of enrollment must have a parent or legal guardian sign the enrollment agreement and liability waiver.
By using the Site, you represent that you meet these requirements and that any information you provide is your own or is provided with the authorization of the person it describes.
2. Acceptable Use of the Site
You agree to use the Site only for lawful purposes and in a way that does not interfere with anyone else’s use of it. You agree not to:
- Submit false, misleading, or fraudulent information, or impersonate another person
- Submit another person’s contact information, including a phone number, without their permission
- Use the Site to send spam, chain messages, or unsolicited commercial communications
- Upload or transmit viruses, malware, or any other harmful code
- Attempt to gain unauthorized access to the Site, our servers, our forms, or any connected system
- Use automated tools such as bots, scrapers, or harvesters to access, copy, or collect content or contact information from the Site, except for search engine crawlers operating within our published robots directives
- Interfere with, disable, or overburden the Site or its infrastructure
- Post or transmit content that is unlawful, threatening, harassing, defamatory, obscene, or that infringes the rights of others
- Use the Site or its content for any commercial purpose without our prior written permission
We may suspend or block access to the Site by any user who violates these Terms, and may report unlawful activity to the appropriate authorities.
3. Inquiries, Registrations, and Application Submissions
The Site allows you to request program information, schedule a campus tour, register for events such as our welding competition, and begin the admissions process.
Submitting a form through the Site is a request for information or an expression of interest. It does not create an enrollment agreement, guarantee admission, reserve a seat in a class, or obligate Heartland Welding Academy to provide any program. Admission is granted only after you complete the full admissions process described on our Admissions page and sign an enrollment agreement.
We make reasonable efforts to respond to every inquiry during our business hours, Monday through Friday, 9:00 a.m. to 5:00 p.m. Central. We cannot guarantee that any submission will be received, delivered, or responded to within a particular timeframe. If your matter is time sensitive, please call 316-776-5246.
Application fees, where applicable, are described during the admissions process and are governed by our Institutional Refund Policy, not by these Terms.
4. Accuracy of Information You Provide
You agree that the information you submit through the Site is accurate, current, and complete, and that you will update it if it changes. This matters: we use the contact information you provide to reach you about your inquiry, your application, and your class start date.
You are responsible for the accuracy of any phone number or email address you provide. If you give us a phone number that is later reassigned to someone else, or that belongs to another person, you agree to notify us promptly so we can update our records. Providing inaccurate information may delay or prevent our response and, in the case of an application, may affect your eligibility for admission or financial aid.
5. Communications by Phone, Email, and Text Message
When you submit a form, you may separately opt in to receive phone calls and text messages. Those checkboxes are optional and are not pre-selected.
Consent to receive marketing calls or text messages is not a condition of enrollment, admission, or of receiving information from Heartland Welding Academy. You can always reach us by calling 316-776-5246 or emailing [email protected].
5.1 Text Messaging (SMS) Terms
If you check the box consenting to text messages, you agree to receive text messages from Heartland Welding Academy at the mobile number you provided.
- Program description: Messages may include program information, admissions and application updates, tour and appointment scheduling and reminders, class start date notices, and — where you have consented to marketing — occasional promotional messages.
- Message frequency: Message frequency varies based on your interaction with us.
- Message and data rates may apply. Heartland Welding Academy does not charge for text messages, but standard message and data rates from your mobile carrier may apply.
- To opt out: Reply STOP to any message at any time. You will receive a single confirmation message and will not receive further texts unless you opt in again.
- For help: Reply HELP to any message, or call 316-776-5246.
- Carriers are not liable for delayed or undelivered messages.
- Carrier and device support: Delivery is subject to carrier availability and may not be supported on all carriers or devices.
- Opt-in data: We do not sell or rent your mobile phone number, and we do not share your SMS consent information with third parties or affiliates for their own marketing purposes. This information is shared only with the service providers that operate our messaging platform on our behalf. Separately, we may provide contact information you have given us to advertising platforms in encrypted (hashed) form so those platforms can deliver our own advertising; those platforms may not use it for their own purposes or disclose it to anyone else. - Your consent is personal. You represent that you are the subscriber or customary user of the mobile number you provide and that you are authorized to consent to receive messages at that number.
5.2 Phone Calls
If you check the box consenting to phone calls, you agree that Heartland Welding Academy and its authorized representatives may contact you at the number you provided regarding your inquiry and our programs, including through the use of automated dialing technology or prerecorded or artificial voice messages. Consent is not required to enroll or to obtain information. You may withdraw consent at any time by telling us during a call, emailing [email protected], or calling 316-776-5246.
5.3 Email
We will email you in response to your inquiry and, where you have opted in, to send program news, event invitations, and other marketing communications. Every marketing email includes an unsubscribe link, which we honor promptly.
5.4 Transactional Messages
Opting out of marketing communications does not stop messages that relate directly to an active request, application, appointment, or enrollment — for example, a tour confirmation or a message about a document we need from you. To stop all contact, please contact us directly.
6. Program and Admissions Disclaimers
Information about programs, curriculum, schedules, tuition, fees, program length, financial aid, certifications, and qualifications is provided for general informational purposes and is subject to change without notice.
- No guarantee of admission. Meeting the published admissions requirements does not guarantee acceptance. Enrollment is subject to seat availability, completion of the full admissions process, and our sole discretion.
- No guarantee of employment or earnings. Heartland Welding Academy does not guarantee employment, job placement, a specific wage, or any particular career outcome to any graduate. Statements about industry demand, typical wages, or graduate outcomes are general information drawn from third-party sources and individual results vary.
- No guarantee of certification or qualification. Earning a welding qualification or certification depends on your performance on the applicable tests and on the standards of the certifying body. Completing a program does not by itself guarantee any certification or qualification result.
- Tuition and fees are subject to change. Amounts published on the Site are current as of the date posted. The tuition, fees, and payment terms that apply to you are those stated in your signed enrollment agreement.
- Financial aid. Availability of grants, scholarships, and financing is subject to eligibility requirements, funding availability, and the rules of the applicable program or lender. Nothing on the Site is a commitment to provide financial aid.
- Program changes. We may modify, reschedule, or discontinue programs, class start dates, and course content. Class start dates are subject to availability.
- The enrollment agreement controls. If anything on the Site conflicts with your signed enrollment agreement, the Student Handbook and Catalog, or our published institutional policies, those documents control.
Our institutional policies — including academic performance, attendance, refunds, grievances, disabilities accommodations, and student conduct — are published on our Policies & Procedures page and are not governed by these Terms.
7. Intellectual Property
All content on the Site — including text, graphics, logos, photographs, video, audio, page layouts, and software — is owned by Heartland Welding Academy or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. The Heartland Welding Academy name, logo, and related marks are trademarks of Heartland Welding Academy.
You may view, download, and print Site content for your own personal, non-commercial use in evaluating our programs. You may not:
- Reproduce, republish, distribute, or publicly display Site content for any commercial purpose
- Modify, adapt, or create derivative works from Site content
- Remove or alter any copyright, trademark, or other proprietary notice
- Use our name, logo, or marks in a way that suggests endorsement, sponsorship, or affiliation without our prior written permission
- Use Site photographs or video of our facility, staff, or students for any purpose without our prior written permission
Third-party names, logos, and marks appearing on the Site are the property of their respective owners.
If you believe content on the Site infringes your copyright, contact us at [email protected] with a description of the work, its location on the Site, and your contact information.
8. Content You Submit
If you submit comments, questions, reviews, testimonials, photos, or other content to us through the Site or in connection with an event or promotion, you grant Heartland Welding Academy a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our programs and marketing, unless we have agreed otherwise in writing. You represent that you own or have the right to submit that content and that it does not infringe anyone’s rights.
Any suggestions or feedback you provide about our programs or the Site may be used by us without obligation or compensation to you.
9. Third-Party Links and Services
The Site contains links to and embedded content from third-party websites and services, including social media platforms, video hosting, mapping services, scheduling tools, financial aid resources, and career exploration tools such as the O*NET Interest Profiler.
These links and embeds are provided for convenience. We do not control third-party sites, do not endorse their content, and are not responsible for their availability, accuracy, content, products, services, or privacy and security practices. Your use of any third-party site is at your own risk and is governed by that site’s own terms and privacy policy.
10. Disclaimer of Warranties
The Site and all content on it are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Heartland Welding Academy disclaims all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Site or the servers that make it available are free of viruses or other harmful components. We do not warrant that information on the Site is accurate, complete, current, or reliable, and we may correct errors or update information at any time without notice.
11. Limitation of Liability
To the fullest extent permitted by law, Heartland Welding Academy and its owners, directors, officers, employees, instructors, agents, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or educational or employment opportunity, arising out of or relating to your access to or use of, or inability to access or use, the Site or any content on it — whether based in contract, tort, negligence, strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site or these Terms will not exceed one hundred dollars ($100.00).
Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law, and nothing in this section limits the rights or obligations set out in a signed enrollment agreement. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless Heartland Welding Academy and its owners, directors, officers, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses — including reasonable attorneys’ fees — arising out of your use of the Site, your violation of these Terms, your violation of any law, or your infringement of the rights of any third party, including any claim arising from a phone number or contact information you submitted that was not yours to provide.
13. Governing Law and Disputes
These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Kansas, without regard to its conflict of law principles. You agree that any legal action or proceeding relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Butler County or Sedgwick County, Kansas, and you consent to the personal jurisdiction of those courts.
Student grievances relating to enrollment, instruction, or institutional policy are handled under our Grievance Policy rather than these Terms.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page and post the revised Terms here. Changes take effect when posted. Your continued use of the Site after we post an update means you accept the revised Terms. We encourage you to review this page periodically.
15. General
If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign or transfer these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and Heartland Welding Academy regarding your use of the Site, and supersede any prior understanding on that subject. They do not supersede any signed enrollment agreement.
